You have to put up collateral. The 10% you put up will never be returned.

His friend decides to bail him out because the reason for my boyfriend getting arrested was partially his friend’s fault. His friend "Bob" calls a bailbondsman and pays him $1000 front and agrees to pay the rest every next months. (the bondsman charges 10% of the bail i guess)

thus, bob signs ALL the paperwork that BOB will make sure to make my boyfriend go to court whenever he is told to and that BOB will make sure to pay the rest of the bail.

My boyfriend lost his job, car, and many of his friends over his arrest and cannot afford to pay the rest of the bond. his friend, bob, is saying that it is not his responsibility to pay the bondsman.

Finally, my question to you folks is this, even though my boyfriend didn’t sign ANY of the paperworks for bail, can he be held responsible for the money BOB agreed to pay?
and i heard something about his bail possibly getting cancelled? if so, how long would he be in jail again?

by the way, this is occuring in orange county, california.

by the way, my boyfriend already showed up to all his court dates and is currently on probabation and has caltrans. he’s doing great with all these, it’s just the whole money issue

Since the bond has been satisfied, and all that is left is the premium, that is a contract issue between the bonding agent and Bob. Your bf cannot be put in jail once he has no further obligation to appear in court (and the bondsman has gotten his bond back as well). I imagine Bob put up some kind of security–the bondsman may move against that. But if the bonding agency has no contract with your bf, then your bf has no legal obligations to the agency.

THIS GUY IS SOOOOO SICK AND WRONG! i know he will get the money… as i know this man personally.. im the victim in this case. I’m not allowed to say how i know him… but lets just put it this way im a foster child now…. i will not give out personal information.. im just saying that i really really really think that the law is really gay and they need to step up!!! the court systems are too nice… and its good sometimes… but not in my case…

You should speak to the D.A. handling this case and find out if there is any options out there for you to get counseling. Considering you have been moved to foster care, it should be available. You did the absolute RIGHT thing by telling, even if all this happens. It would not have stopped happening to you. In fact, he probably would have gone on to hurt someone else the same way he hurt you. Good luck sweetie.
